Terms of Service

These Terms of Service ("Terms") govern your use of PropSafe, operated by Kevin McIntosh, trading as PropSafe ("PropSafe", "we", "us", "our"). By using PropSafe, submitting a request, uploading a document, or making a payment, you agree to these Terms. Please read them carefully. If you do not agree, do not use the service.

1. What PropSafe is, and is not

PropSafe provides an automated, AI-assisted information service that flags potential risk patterns in overseas property developers and contracts, checked against a country-specific rulebook. PropSafe is not a law firm, conveyancer, notary, real estate agent, or licensed financial services provider. Our reports, risk flags, and notary checklists are information only. They are not legal advice, title certification, a guarantee, or financial or investment advice. You must have any deal independently reviewed by a qualified local professional, such as a licensed Indonesian notary (PPAT) or a Thai property lawyer, before signing or transferring funds.

2. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use PropSafe.

3. What we can and cannot see

Our checks rely on the documents you provide and publicly available information. We cannot access private records, undisclosed disputes, or information not in the public domain, and we cannot detect deliberately falsified documents. The absence of a flag in a report does not mean a deal is safe, and the presence of a flag does not necessarily mean a deal is unsafe. A PropSafe report is one input into your decision, not a substitute for professional advice.

4. Your responsibilities

You confirm that you are entitled to submit any document you upload, and that doing so does not breach anyone's rights or confidentiality obligations. You agree to provide accurate information, to use the service lawfully, and not to misuse, copy, resell, or attempt to disrupt or reverse-engineer the service. You remain solely responsible for your own property decisions.

5. Orders, pricing, and payment

Prices are displayed on our pricing page and are shown in Australian dollars by default, with other currencies available for convenience. Payments are processed securely via Stripe; by purchasing, you also agree to Stripe's terms. We may update our prices and packages from time to time, but changes will not affect orders already placed.

6. Delivery

We aim to deliver reports within the timeframe stated at the point of purchase, typically within minutes for automated reports. Some higher-tier services include a human follow-up, which may take longer. If we are unable to deliver your report, we will contact you to resolve it.

7. Refunds and cancellations

Because our reports are digital and produced specifically for you, we do not offer change-of-mind refunds once a report has been generated. If we are unable to deliver a report you have paid for, we will provide a full refund. Nothing in this section limits your rights under the Australian Consumer Law, including any rights to a remedy where a service is not provided with due care and skill or does not match its description.

8. Intellectual property

We retain all intellectual property rights in PropSafe, including our website, rulebooks, report formats, and content. When you purchase a report, we grant you a personal, non-transferable licence to use that report for your own due diligence. You retain ownership of the documents you upload.

9. Disclaimers

To the maximum extent permitted by law, PropSafe is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or that any report will identify every risk relevant to a transaction.

10. Limitation of liability

To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, PropSafe is not liable for indirect or consequential loss, or for losses arising from developer conduct, project failures, title disputes, regulatory changes, currency movements, or your own decisions. Where our liability cannot be excluded but can be limited, our total liability is limited, to the extent permitted by law, to the amount you paid us for the relevant service.

11. Privacy

Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.

12. Changes to the service and these Terms

We may update, suspend, or discontinue parts of the service, and we may update these Terms from time to time. The "last updated" date above shows the latest version. Your continued use of PropSafe after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Australia and the courts competent to hear appeals from them, subject to any non-excludable rights you have under Australian law.
