This site and service ("PropSafe") are operated by Kevin McIntosh, trading as PropSafe ("PropSafe", "we", "us", "our"). We respect your privacy and are committed to protecting your personal information. This policy explains what we collect, how we use and protect it, and the rights you have. We handle personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

By using our website or services, you agree to the collection and use of your information as described in this policy.

We collect information directly from you when you fill in a form, upload a document, make a purchase, or contact us. We also collect some information automatically through cookies and similar technologies when you use our site (see section 5), and we may receive limited information from our service providers, such as confirmation of a successful payment from Stripe.

When you request our free guide or otherwise give us your email, you consent to receiving related updates and occasional marketing emails from us, as noted at the point of sign-up. Every marketing email includes an unsubscribe link, and you can opt out at any time by using that link or by contacting us. Opting out of marketing does not stop essential service messages, such as delivery of a report you have purchased.

We use cookies and similar technologies to run the site, remember your preferences, understand how the site is used, and to measure and improve our advertising. This includes advertising pixels such as the Meta (Facebook) Pixel, which help us measure ad performance and reach relevant audiences. These advertising tools are active by default. You can opt out by choosing "Decline" on the cookie banner on our site, or by controlling cookies through your browser settings. Declining does not prevent you from using the core features of the site.

6. When we disclose information

We rely on trusted service providers to operate, and we share with them only what is needed to deliver our service. These include payment processing (Stripe), email delivery (SendGrid), email marketing (Klaviyo), AI processing (Anthropic), advertising measurement (Meta), and hosting providers. We do not sell your personal information. We may also disclose information where required or authorised by law.

Because we analyse overseas property and use international service providers, some of your information may be stored or processed outside Australia, including in countries where our providers operate. Where this happens, we take reasonable steps to ensure your information is handled consistently with this policy and the Australian Privacy Principles.

8. How we protect your information

We take reasonable technical and organisational measures to protect your information against loss, misuse, and unauthorised access, including encryption in transit and access controls. No method of transmission or storage is completely secure, but we work to safeguard your information and to limit how long we hold it (see section 9).

9. How long we keep it

We keep your information only as long as needed for the purpose it was collected and to meet our legal and record-keeping obligations. The raw contract documents and contract text you upload are deleted from our servers within approximately 30 days of your review. We retain the assessment we generate from them — the report content, the risk rating, and the market and developer or project names involved — on an ongoing basis so we can monitor risk trends and improve the quality of our service; this retained material is not a copy of your original contract. Email addresses are retained until you unsubscribe or ask us to delete them. You can ask us to delete the personal information we hold about you at any time (see your rights below).

10. Your rights

You can ask us to access, correct, or delete the personal information we hold about you, and to stop sending you marketing. To make a request, contact experts@propsafe.au. We will respond within a reasonable time. If you have a privacy concern we cannot resolve, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

Our services are intended for adults aged 18 and over. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can remove it.

12. Third-party links

Our site may link to third-party websites. We are not responsible for the privacy practices or content of those sites, and we encourage you to read their privacy policies.

We may update this policy from time to time. The effective date above shows the latest version. Where changes are significant, we will take reasonable steps to notify you.
